Ia dimasukkan dalam Perlembagaan selepas berlakunya proses perundingan, permuafakatan atau kata sepakat secara kolektif di kalangan pemimpin pelbagai kaum di negara ini ketika itu. Hakikatnya, kelima-lima perkara itu adalah satu bentuk kontrak sosial yang menjadi asas penting bagi mewujudkan perpaduan kaum di negara ini. Menurut Dr Hassan Ahmad, dari segi kemanusiaannya, kontrak sosial yang dilaksanakan di negara ini tidak sedikit pun mendiskriminasikan kaum lain. Malah, ia memberikan asas penyelesaian masalah perkauman yang wujud hasil daripada penjajahan British.
